This morning, the Federal Trade Commission (FTC) announced a $40 million Settlement Agreement with Skechers, the manufacturer of popular toning shoes including Shape-ups, Resistance Runner, Toners and Tone-ups. The announcement was made after a multi-state investigation concluded the company made unsubstantiated claims that wearing the shoes would lead to better muscle tone, weight loss and improved cardiovascular health. Consumers who desire a refund have eight months to file a claim through the FTC website for a return of the purchase price of the shoes. Unfortunately, Skechers’ toning shoes did more harm than good to the unsuspecting consumers that purchased them for their perceived health benefits. Despite spending $100 or more for a pair of the shoes, many people actually were seriously injured while wearing them. Today’s announcement is a huge win for consumers in the fight against deceptive marketing practices. As part of the agreement, Skechers is banned from making any health claims about their products because their health claims are not backed by scientific evidence. The settlement with Skechers is part of the FTC’s ongoing effort to stop exaggerated advertising claims, and follows a similar settlement with Reebok International Ltd. last year. Manufacturers must be held accountable for the false promises they make to unsuspecting buyers.
If you purchased Skechers Shape-ups shoes, you have eight months to file a claim for a refund. Consumers who bought these “toning” shoes will be eligible for refunds directly from the FTC. It is unclear how much each consumer will be refunded, although the amount is expected to be significant. At this time, you do not need a store receipt to file a claim.
Perhaps the most important part of today’s announcement is that it supports our claim that Skechers deceived the public by making false claims that the shoes were good for you. Instead, we now have rock solid proof that the claims were bogus and the shoes were dangerous.
