Janet, Jenner & Suggs’ Attorney Kim Dougherty Named to Help Lead Plaintiffs Cases against NECC

On April 9, Judge Saylor of the U.S. District Court, District of Massachusetts, announced the Plaintiffs Steering Committee for In re: New England Compounding Pharmacy, Inc. (MDL No. 1:13-md-2419-FDS)

Kim Dougherty, an attorney and Manager of the Boston office of Janet, Jenner & Suggs, LLC, has been appointed to the Plaintiffs Steering Committee (PSC) in litigation against New England Compounding Center over allegations related to a national outbreak of fungal meningitis.

The PSC will coordinate discovery, hearings, trial, and settlement negotiations on behalf lawsuits filed in federal courts against NECC, according to the order issued Tuesday by U.S. District Judge F. Dennis Saylor, of the District of Massachusetts. Saylor is presiding judge over the Multi District Litigation (MDL) established to consolidate procedures for some 150 lawsuits against NECC filed in federal court.

“I am honored to be appointed to the committee,” said Dougherty, “Our goal will be to move the litigation forward as efficiently and forcefully as possible, and ensure all the plaintiffs obtain the justice and compensation they deserve. Certainly, the entire PSC has quite a task in front of it given the number of cases filed and the hundreds of families that were affected,” she added.

Ms. Dougherty said JJ&S currently represents some 80 families in litigation against NECC over the illness outbreak.

The lawsuits allege NECC prepared and shipped thousands of contaminated steroid injections from its Massachusetts facility, causing more than 700 cases of fungal meningitis and 53 deaths nationwide.

Dougherty has successfully negotiated significant pre-suit personal injury settlements and mediated several substantial recoveries in pharmaceutical liability tort actions across the country. She currently serves on the executive committee for Transvaginal Mesh mass tort cases pending against Boston Scientific and Tyco/Covidien.

In 2013, Dougherty was named among the Top 40 Under 40 by the National Trial Lawyers, and has been named a New England Rising Star by the Association for Justice.
